OVERVIEW

Bespoke Garden Rooms Ballycastle (“we”, “us”, “our”) is a Northern Ireland–based design and manufacturing com2any specialising in custom-built garden rooms, modular structures, and outdoor installations.

By requesting a quotation, making payment, or instructing us to proceed, you agree to be bound by these Terms of Service (“Terms”).

1 QUOTATIONS AND CONTRACT FORMATION

1. Quotations remain valid for 30 days unless otherwise stated.

2. Acceptance—by written confirmation, email, message, or deposit—constitutes a binding contract under these Terms.

3. Payment structures:

•⁠ ⁠Projects over £30,000: 50% deposit | 40% on commencement or delivery of materials | 10% on completion.

•⁠ ⁠Projects under £30,000: 50% deposit | 50% on completion.

•⁠ ⁠Bespoke manufactured items (e.g. custom joinery, furniture, made-to-order fittings): payment in full on booking before production begins.

4. Once accepted, an order cannot be cancelled without written consent. Any cancellation may incur costs for labour, materials, or scheduling disruption.

2 BESPOKE NATURE OF PRODUCTS

All garden rooms and associated joinery are custom-made to order and therefore exempt from standard consumer return rights.

Natural variations in timber, grain, or finish are not considered defects.

3 SITE ACCESS AND PREPARATION

Clients are responsible for providing safe, clear access to the site and ensuring it is suitable for installation.

Any obstruction, delay, or unsafe condition may result in additional charges for wasted time or rescheduling.

4 DESIGN, MATERIALS, AND PRICE ADJUSTMENTS

1. Prices are based on material and labour costs at the time of quotation and may change if market rates increase or the client requests alterations.

2. Should a specified material become unavailable, we reserve the right to substitute an equivalent or superior option.

3. Any significant change will be notified for approval before proceeding.

5 PAYMENT TERMS

1. All invoices must be paid strictly in accordance with the agreed schedule.

2. Late payments will accrue interest at 8% per annum above the Bank of England base rate, calculated daily at approximately 0.0219% per day, and applied until the balance is settled in full.

3. We reserve the right to recover reasonable costs, including legal and administrative fees, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

4. Failure to make payment may result in suspension of works, retention of goods, or removal from site until the account is cleared.

5. Ownership of all goods and materials remains with Bespoke Garden Rooms Ballycastle until payment has been received in full.

6. Deposits are non-refundable and non-transferable, as all orders are bespoke.

6 VARIATIONS AND ADDITIONAL WORK

1. Any modification to the design, specification, or materials constitutes a variation.

2. Verbal or on-site instructions confirmed by our project manager are binding once recorded in project notes or messages.

3. Variations may require advance payment or will otherwise be added to the final invoice and must be settled prior to completion handover.

4. Where the scope of works changes significantly, a revised quotation will be issued.

7 DELAYS AND FORCE MAJEURE

We shall not be held liable for delays caused by weather, supply chain issues, illness, or other events beyond our control.

We will communicate promptly regarding any delay and reschedule where possible. Delay does not constitute grounds for cancellation or non-payment.

8 WARRANTY AND AFTERCARE

1. All garden rooms include a 12-month workmanship warranty from completion.

2. Structural components such as framing or roofing may include extended cover if stated in writing.

3. This warranty excludes natural timber movement, fading, or weather-related wear.

4. Unauthorised repairs or alterations by third parties void the warranty.

9 LIABILITY AND INDEMNITY

1. Our total liability under any contract is limited to the total contract value.

2. We accept no liability for indirect or consequential loss, including loss of profit, enjoyment, or opportunity.

3. The client shall indemnify us against any loss or damage resulting from unsafe site conditions, third-party actions, or unauthorised interference.

10 TERMINATION

We reserve the right to suspend or terminate works where:

•⁠ ⁠Payment is overdue;

•⁠ ⁠The client obstructs progress or refuses access; or

•⁠ ⁠Site conditions are unsafe or unlawful.

All outstanding sums up to the termination date remain payable.

Materials and goods may be retained or recovered until full settlement is made.

11 INTELLECTUAL PROPERTY

All designs, drawings, and concepts remain the intellectual property of Bespoke Garden Rooms Ballycastle and may not be copied, reproduced, or shared with third parties without written consent.

12 GOVERNING LAW

These Terms are governed by the laws of Northern Ireland, United Kingdom, and any disputes shall fall under the exclusive jurisdiction of the Northern Ireland courts.

13 VERBAL AGREEMENTS & CONFIRMATION

Verbal or on-site instructions confirmed by our project manager are deemed enforceable and form part of this contract.
